Court says Obesity is not a Disability

If you are reading this odds are you know obesity isn’t a disability its a shitty situation you put yourself in, now a federal court is agrees.

The 8th Circuit Federal Court of Appeals has clarified the definition under which an employer can be sued for discrimination because of a disability. In the case of Melvin Morriss, III v BNSF Railroad Co., the plaintiff was denied a job as a machinist because of his high Body Mass Index (BMI), a measurement of obesity.

Under its policy, BNSF “will not hire a new applicant for a safety-sensitive position if his Body Mass Index (BMI) equaled or exceeded 40.” Morriss sued the company on the grounds that his rights were violated under American with Disabilities Act (ADA).

A BMI of 40 btw would require someone who is six feet tall to weigh over 300 lbs. Melvin is roughly the same height as me but ~100 lbs heavier. Oddly enough when he applied he claimed he was *surprise surprise* perfectly healthy with no impairments. I’m not surprised to see another fatty trying to claim they are disabled when they don’t get what they want.

So sound the tumblr alarm because America is finally putting its foot down on fatties. Stuffing your face because you are obese isn’t a disability, and  fatties will not be awarded the same treatment and protections of those who are actually disabled. The original decision was appealed and the pudgy plaintiff was given the same decision days later.
